Tertiary education environment has been changing rapidly, and thus the Law impacts are becoming more demanding. Some of the factors contributing to this environment include cybercrime bullying to students taking their lives (Kaplin and Lee 2014). The law helps to ensure that one is protected from the problems that may arise. Online education has also come in the limelight and hence expanded on the needs of law in higher education. Increased computer and phone network has also brought a need for change on the previously existing laws of higher to accommodate new needs in the society.
All the universities and other higher education institutions in the USA are controlled by a board of trustees. Their legal obligation is essentially the same and hence forms a crucial part in making the law for higher education students in the United States. The state is also a crucial source of law in higher education since it gave the charter. The public welfare is also a crucial source of the laws to be written in a higher education institution (Kaplin and Lee 2014)
Also, with the aggressively changing university environment, laws must change to accommodate issues arising with technology and large numbers currently flooding in the universities. Undergraduate candidate numbers have highly risen over the last century, and hence the law is being tailored to ensure fast and fair delivery of justice in places of higher education (Kaplin and Lee 2014). Another benefit is that unlike before more religious organizations have come to place and hence rights for various religious groups in the higher education institutions have to be also respected the financial costs for expanding various legal entities are high but equally important to ensure that institutions of higher education observe the law and everyone is treated fairly. It is also a course manual to ensure students know the consequences for each action they do.
